Terms of Service & SMS Terms
Draft terms for an introduction-only project connecting individual adults.
1. About Adopt Canada
“Adopt Canada” is a working project name for a website intended to help individual adults in the United States find and connect with individual Canadian families interested in receiving practical household items. The website is not a corporation, registered nonprofit, charity, tax-exempt organization, social-service agency, fiduciary, broker, marketplace, or government program.
The website does not accept charitable donations, issue tax receipts, hold funds, purchase goods for participants, or take ownership of goods. A supporter's decision to purchase an item is a voluntary, personal transaction made independently through a third-party retailer.
2. Acceptance and eligibility
By accessing the site or submitting a form, you acknowledge these Terms and the Privacy notice. Participation is limited to adults who are at least 18 years old and legally able to make their own decisions and purchases. Do not use the site if you do not agree with these Terms.
3. Introduction-only role
The site may collect interest information, make an introduction, and share a family-provided wishlist. The site does not become a party to any relationship or transaction between participants. Unless expressly described in a later written policy, the operators do not guarantee that any participant has been screened, verified, or is who they claim to be.
Participants are responsible for their own judgment, safety, communications, purchases, taxes, customs consequences, account security, and compliance with retailer rules and applicable law.
4. Personal transactions; no tax benefit
Any item purchased for another person is a personal gift from one individual to another. No payment is made to Adopt Canada. Participation does not create a charitable contribution, tax deduction, or tax receipt. Consult your own tax adviser if you need advice about a purchase or gift.
5. Safety and prohibited conduct
You agree not to:
- send or request cash, gift cards, cryptocurrency, passwords, government identification, banking information, or other sensitive data through the site;
- misrepresent your identity, circumstances, location, or needs;
- harass, threaten, discriminate against, exploit, or deceive another participant;
- use participant information for advertising, lead generation, resale, public posting, surveillance, or any purpose unrelated to the introduction;
- attempt to compromise the site, forms, accounts, or third-party services; or
- use the site for unlawful activity.
If a request or interaction appears suspicious, stop communicating and contact info@adoptcanada.org. The site is not an emergency service.
6. Third-party services
The site may link to or use Formspree, Amazon.ca, email, telecommunications providers, and other third-party services. Those services have their own terms, privacy practices, availability, fees, and security controls. Adopt Canada is not affiliated with Amazon and does not control or guarantee third-party services.
7. No guarantee of a match or outcome
Submitting a form does not guarantee acceptance, a response, an introduction, a match, a purchase, delivery, continued support, or any particular result. Either individual may decline or end participation at any time.
8. Disclaimers
To the fullest extent permitted by applicable law, the site and introduction service are provided “as is” and “as available,” without warranties of accuracy, availability, fitness, safety, identity, conduct, delivery, or outcome. Nothing on the site is legal, tax, financial, medical, or social-service advice.
9. Responsibility and limits
Each participant is responsible for their own conduct and decisions. The final Terms must be reviewed by counsel and revised to identify the operator and include enforceable limitations of liability appropriate to the governing jurisdiction. This draft does not attempt to waive rights that cannot lawfully be waived.
10. SMS Terms
Program description
If you separately opt in, the people operating Adopt Canada may send conversational and program-related text messages about your inquiry, supporter registration, matching, safety notices, or participation. SMS is optional.
Consent
You opt in only by entering your own mobile number and checking the separate SMS consent box. Consent is not a condition of participation, a match, a purchase, or receiving information by email. You represent that you are the subscriber or customary user of the number provided and are authorized to consent.
Frequency and charges
Message frequency varies. Message and data rates may apply according to your wireless plan. Adopt Canada does not charge a separate SMS fee.
Opting out
Reply STOP to an incoming message to opt out. Requests using other words or reasonable methods that clearly communicate a desire to stop must also be honored as required by applicable law. A single non-promotional confirmation message may be sent after an opt-out request. You may also request opt-out by emailing info@adoptcanada.org.
Help
Reply HELP for help or email info@adoptcanada.org. If two-way texting is unavailable, each message must identify a reasonable alternative opt-out method.
Delivery
Message delivery is not guaranteed and may be affected by your device, carrier, location, filtering, or service availability. Wireless carriers are not responsible for delayed or undelivered messages.
Privacy
Mobile numbers and SMS consent records are handled as described in the Privacy notice. The operators should not sell mobile opt-in information or SMS consent.
11. Changes and ending access
The operators may update or discontinue the site, matching process, or messaging program. Material changes should be posted with a revised effective date. Participants may stop using the site at any time and may revoke SMS consent as described above.
12. Governing law and operator identity
Required before launch: identify the individual operator or future entity, physical or mailing contact address, governing law, venue, and effective date. These details should be selected with qualified legal advice and must not be guessed.
